OAK CREEK PARKWAY POA BY-LAWS & COVENANTS

A.    Establish Quorum
Twenty-five percent (25%) of the Lots in the Subdivision must be represented to constitute a quorum.
Number necessary for Quorum is 31 lots
The quorum was established by the 31 lots represented in person or via proxy and the Board utilizing the votes of members who did not attend or provide proxy.


·         Existing Board:  President-Chris Dean, Vice President -Marc Foreman, Treasurer-Connie Andersen, Secretary- Diane Hopkins-Broyles
·         Chris opened the floor for nominations for office.
·         Al Mitchell made motion to nominate the existing board. Mike Pearson seconded the motion.
·         No other nominations were made.
·         Al Mitchell made a motion to close nominations and elect the current board. Mike Pearson seconded the motion.
·         Voice vote was completed and the present board was elected for another term by majority.

E.    Budget Report
This report reflects information as of May 31, 2018
a)     Balance Sheet was reviewed
Checking          $19,686.72
Savings                        $68,277.03
Total                 $87,277.03
b)    May Profit and Loss sheet was reviewed
Income             $9,375 (dues and late fees)
Total Expenses              $11,821.32
Net Income       -$2,446.32
The income is negative for May due to insurance ($4,152) and large water break in April that was paid in May ($1,775) along with regular expenses.
c)     Year to Date (Jan - May) Profit and Loss sheet
Income             $51,956.63 (dues, late fees, and interest)
Expenses         $41,550.28
Net Income       $10,406.35 –comparison to last year at this time $13,000
d)    Snow removal since Jan was $2,935. This was due to ice and cost of salt to address the issue.
e)     The clubhouse was paid off in 2016. Have we saved any money?
2016 saved $32,000
2017 saved $15,000 in addition to the $20,000 spent on roads.
The road work included tennis court drainage work, rocks along road to help stop the road from peeling off and fixing the area by Austin and Jackson.
2018 so far saved $10,000
f)     To date this year Ozark Environmental has been paid $17,500 compared to @$14,225 last year.  The difference is due to more water breaks this year.
Several questions were asked regarding Ozark Environmental:
A.    Is there any indication that Ozark is going to raise fees?   Fees were raised couple of years ago and there is no indication they plan to raise this year. We are currently under contract.
B.    Can we control the number of people they bring when they work on an issue? Is there is anything in our contract? There is nothing in the contract to address this.  Connie can see on the bills how many people we are charged for.  Generally, it is a supervisor and a helper. No problem seen.
C.    How much overtime where we charge for during the April water break.  They only charged us for 1 hour of overtime and they definitely were there late that evening.
D.    What is the drinking water fee?  Once a year the drinking water is tested.  They test water at 5 sites (homes) and the tank and pump.

F.    Proposals to Pave roads
g)    The group discussed the information about roads and proposals regarding paving roads
o    Angora and Rock Ridge are county roads and are maintained by the county
o    There is hope that the county would take over some of the roads in the subdivision but it is not known when or if this would ever happen.  We are on a list for consideration but there is no timeline for when we would be considered and we would definitely need to have a 2-inch cap placed on the road.  In addition, if the county took over roads it would probably only be Austin. They would not consider Bethany, Andrew, or Oak Creek Circle.
o    The rock road at end of Rock Ridge past Angora is owned by Million Oaks. We have an easement from Million Oaks that runs from end of pavement to cul-de-sac. There are 5 homes on that strip of road that is part of Oak Creek Parkway. We do not have the ability to do anything with that road. At one time an attempt was made to smooth out the road and the crew was stopped.
o    An estimate was received from Blevins Paving to pave all the roads in subdivision for $170,934.50. This would be a 2 inch cap.
o    A rough estimate of a loan ($180,000) to complete the roads: 15-year loan with an interest rate of 7.7% would cost the subdivision @$1,700 per month.
o    Some funds in the saving account would be used toward roads—possibly $20,000 to $50, 000
o    Discussion about increasing monthly due occurred.  There was discussion regarding if our dues were higher than other HOAs. There were differing opinions regarding this topic.
o    If dues were raised $21/month the loan would be covered.  There is some concern about raising dues because many homeowners are on a fixed income.  Also, discussion that if dues were raised $10 month it would cover the difference between what we had been paying on the clubhouse loan and estimated cost road paving loan.
o    Discussed applying an increase in dues for both homeowners and lot owners.
o    Discussed 3 options for roads:  1) patch roads and see what happens, 2) do part roads this year and rest next year, 3) do all this year.
o    A proposal was made by Mike Brandsma to: 
Pave all roads at once and have a subcommittee headed by Dave Gubin figure out the financing before the end of June.
The motion was seconded by John Goff.
18 voted in favor of proposal and 4 were not in favor of motion. Motioned was carried.
·         Subcommittee volunteers: Dave Gubin (chair), Connie Anderson, Mike Brandsma, Loretta Slater, Al Mitchell, Chris Dean, and Diane Hopkins-Broyles
·         The findings of the subcommittee will be provided to Board for consideration and final decision.
o    The attendees were asked if there was any opposition to raising dues $10 month if necessary to pay for roads?
The question was asked if dues would be decreased once roads were paid off. The thought was due to inflation and fact the dues have not been raised in several years they would not be reduced.
No opposition was voiced regarding a $10 increase.
G.    Vandalism/Unlawful use of private and community property
a)     Use of dumpster
Discussed that dumpsters should be used for household goods
Cardboard boxes need to be broken down
There is an investigation into buying a HD camera with recorder. This will allow better capture of faces and time stamp. Estimated cost $150.
If dumpster are piled to high we are charged an extra $15.  It was suggested that if dumpster are full please take trash home until dumpster emptied.
Do not overfill or leave trash outside dumpsters.
b)    Recreation areas
Volunteers are needed to clean tennis courts
Tennis court next has a broken piece that tightens net—Chris suggested the next be fixed and piece be bought.
c)     Repair of signs
Board will discuss at next meeting

John Goff made a motion to adjourn meeting at 2:10, seconded by Barb Rivers, all were in favor.
